A dispensary has sued the Town of Bernalillo because the town wants the business to repaint its bright green color.

The lawsuit, filed June 26, appeals a Bernalillo Town Council decision to order The Dispensary Near Me, a cannabis dispensary located at 413 South Camino Del Pueblo in Bernalillo, to repaint its building following public complaints that the bright green color made an aesthetic impact on the streetโ€™s historic ambiance.

Bernalillo Mayor Jack Torres said he could not comment on pending litigation.

At a May 28 meeting, the town council overturned an earlier decision by the Planning and Zoning Commission that had permitted the dispensary to use a bright green color for its exterior paint.

Trevor Donaldson, owner of Dispensary Near Me, added color above the buildingโ€™s portal which was not approved by the planning department, prompting residents who were worried about preserving the town’s heritage, to appeal the Planning and Zoning Commissionโ€™s approval of a variance request. According to the councilโ€™s order, Donaldson was required to repaint the buildingโ€™s exterior no later than June 28.
The Signpost reached out to Donaldson for comment but did not hear back as of press time.
